This page describes the store build of Spark: Escape to Luma. It is a practical notice for players and for app-store review, not a law-firm opinion.

These terms are between you and Kailan Wyatt for Spark: Escape to Luma and for this website. The app id is com.kurt.sparkescapetoluma. If you do not agree, do not install the game or use the site.

The game

Spark: Escape to Luma is a precision game about guiding a living spark of energy home. It is coming soon to the App Store and Google Play. A feature described on this site can change before release, and a test build may turn some features off.

License

We grant you a personal, non-exclusive, non-transferable license to install and play the game on devices you own or control, under the rules of the store you use. You do not own the game, its art, the name Spark, or its story. You may not copy the game for sale, or modify it, except where the law does not allow that limit.

No account

The game does not create an account. Progress is stored on your device. We cannot sign you in on a new phone, and we cannot recover a save after you delete the app. See Your Data.

Virtual items

Shards, energy, timed unlimited energy, boosts, and cosmetic sparks and trails exist only inside the game. They are a license to use a feature, not a balance of money. They have no cash value, and they cannot be transferred or redeemed outside the game. An update may change how they work, including cost and availability.

Purchases

When the game offers a purchase, Apple or Google charges you and keeps the payment record. We do not receive your card number. A refund is requested from Apple or Google under that store's rules. Remove Ads stops forced interstitial ads and does not stop optional rewarded ads. The details are in the Advertising Policy.

Advertising

A store build may show ads as described in the Advertising Policy. That policy is part of these terms.

Acceptable use

Do not attack the game or other people through it, do not misuse the support email, and do not use the game or this site to break the law.

This website

This site describes the game and publishes the privacy, advertising, terms, support, and data pages. It does not create an account.

App stores

If you download the game from Apple, Apple is not a party to these terms and is not responsible for the game or for a claim you have about it. Apple's licensed application terms still apply where Apple requires them. If you download it from Google, Google is not responsible for the game. The store you used can enforce its own rules, including payment rules.

Disclaimer

The game and this site are provided as they are. We do not promise uninterrupted play, that a level will stay unchanged, or that a coming-soon feature will ship on a particular date.

Limitation

To the extent the law allows, Kailan Wyatt is not liable for indirect or consequential damages, or for progress that existed only on your device. These terms do not limit a right that the law says cannot be limited.

Changes

We may update these terms by posting a new version on this page and changing the date. Playing a later version means you accept the terms posted for it. If you do not accept them, stop using the game and delete it.
